CCL has the unique distinction of having been selected as the 3rd-Party construction consultants to the International Chamber of Commerce (ICC)’s International Court of Arbitration’s tribunal panel, of a dispute on a new nuclear power station that was built in Olkiluoto, Finland. The dispute was between Teollisuuden Voima Oyj (TVO) a Finnish nuclear power company and Areva NP (a joint venture of Areva and Siemens) the design-build contractor.

The Olkiluoto 3 (OL3) nuclear reactor started construction in 2005 and went online in 2023. The OL3 reactor was a new-generation European Pressurized Reactor (EPR) and was Europe’s most powerful nuclear reactor at 1,600MW.

The OL3 project went grossly over-budget and was severely delayed due to the reactor being of a new design and the contractor lacked the expertise to fully mitigate the regulatory requirements of the Radiation and Nuclear Safety Authority (STUK), the Finnish nuclear safety regulator.

Due to the complex nature of each side’s claims, CCL was chosen to provide explanations and opinion to the ICC’s tribunal of arbiters. Attending the hearings with the tribunal provided CCL with the unique opportunity to review each side’s claims from an independent third-party perspective.

The common difficulty in nuclear-related construction is anticipating and avoiding the events that may delay project completion. With this past experience CCL can help plan and schedule nuclear-related projects by anticipating potential disruptions and shortages; and anticipating the duration of multiple inspections required for fabrication and installation.
